Application Store means the digital distribution service operated and developed by Apple Inc. (Apple App Store) in which the Application has been downloaded. Account means a unique account created for You to access our Service or parts of our Service securely via Sign in with Apple. Country refers to: Schleswig-Holstein, Germany. Device means any device that can access the Service such as a computer, a cell phone or a digital tablet. Service refers to the Application (KARG). Lifetime Purchase refers to a one-time payment granting You access to premium features of the Service for as long as the Application remains available and supported by the Company. Subscriptions refer to the services or access to the Service offered on a subscription basis by the Company to You (if applicable). User Data refers to the private financial information (such as expenses, budgets, and savings goals) that You input, log, or track within the Application. Terms and Conditions (also referred to as "Terms") means these Terms and Conditions which govern Your access to and use of the Service. You means the individual accessing or using the Service. Acknowledgment These are the Terms and Conditions governing the use of this Service and the agreement between You and the Company. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service. Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users and others who access or use the Service. By accessing or using the Service You agree to be bound by these Terms and Conditions. Please read Our Privacy Policy carefully before using Our Service. Purchases, Subscriptions, and Lifetime Access Lifetime Access The Service is primarily offered as a one-time "Lifetime" purchase. A "Lifetime Purchase" grants You full access to the premium features of KARG for the lifespan of the Application. "Lifetime" strictly refers to the lifetime of the Service itself, not Your lifetime. In the event that the Company ceases business operations or decides to discontinue the Application, Your access may be terminated without a refund. Billing and Apple App Store All payments, billing, and renewals (if applicable) are handled exclusively by the Application Store (Apple Inc.). Payment will be charged to Your Apple ID account at confirmation of purchase. The Company does not collect or store Your credit card information. Refunds Because transactions are processed by Apple, the Company cannot grant refunds directly. Except when required by law, paid fees (including Lifetime Purchases) are non-refundable. Any request for a refund must be submitted directly to Apple Support in accordance with Apple’s refund policies. Fee Changes The Company, in its sole discretion and at any time, may modify the price for the Lifetime Purchase or introduce new Subscription fees. Any fee change will not affect users who have already successfully purchased a Lifetime unlock. User Accounts and Data When You create an Account with Us (via Sign in with Apple), You must provide Us information that is accurate, complete, and current. You are responsible for safeguarding the credentials You use to access the Service. You agree to notify Us immediately upon becoming aware of any breach of security or unauthorized use of Your Account. Your Private Data KARG is a privacy-first tracker. You retain full ownership of all User Data (expenses, budgets, savings) you enter into the App. By using the Service, You grant Us a limited license to securely host, store, and sync this data across Your devices using our backend infrastructure. We will never sell, publish, or share Your specific financial User Data with unauthorized third parties. Data Backups and Offline Mode The Application features an offline mode and cloud syncing. Although we utilize enterprise-grade backend providers to store your User Data, the Company does not guarantee there will be no loss or corruption of data due to network failures, device errors, or server outages. You acknowledge that maintaining secondary backups of your financial records is Your own responsibility. Financial and Investment Disclaimer (No Financial Advice) No Financial Advice: The Application is a tool designed strictly for informational, educational, and personal organizational purposes regarding expense tracking and budget management. The Application is NOT a financial advisor, tax professional, broker, or legal entity. No Guarantee of Results: We do not guarantee any specific financial results, wealth generation, or debt reduction from using the Application. Any financial insights, remaining budgets, or "Leftover" calculations displayed in the App are based entirely on the raw data You input. Your Responsibility: You must use Your own judgment before making any financial decisions, purchases, or investments. The Company is not responsible for any financial losses, missed savings goals, overdraft fees, or tax liabilities incurred while using the Service. Termination We may terminate or suspend Your Account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions. Upon termination, Your right to use the Service will cease immediately, and your User Data may be permanently deleted from our active servers. You may also voluntarily terminate your agreement at any time by utilizing the "Delete Account" function within the Application, which will permanently erase your User Data. Limitation of Liability Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of these Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You through the Service, or 100 USD if You haven't purchased anything through the Service. To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data, loss of savings, business interruption, or loss of privacy arising out of or in any way related to the use of or inability to use the Service), even if the Company has been advised of the possibility of such damages. Some states/jurisdictions do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, so some of the above limitations may not apply. "AS IS" and "AS AVAILABLE" Disclaimer The Service is provided to You "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.
